Maritime security is of paramount importance for the security of coastal States and maritime transport. As demonstrated by recent Houthi attacks in the Red Sea, the situation concerning maritime security is increasingly severe. The South China Sea is a lifeline for oil and gas supplies and is crossroads of maritime transport. In light of its economic, strategic and political importance, it would be no exaggeration to say that maritime security in the South China Sea may affect all countries. Here various questions arise: What is the role of law in the maintenance of maritime security? What are the implications from a commercial law perspective? How is it possible to peacefully settle international disputes concerning maritime affairs? What is the role of an international court or tribunal in the settlement of international disputes in this field? The Hans Island agreement between Canada and the Kingdom of Denmark and the 2016 South China Sea arbitration between the Philippines and the Peoples’ Republic of China provide insight into these questions.
